The Contract of Sale and Vendor Statement
If you have engaged a Real Estate Agent to sell your property, then make sure you arrange for a Vendor’s Statement and contract for sale of land to be prepared by Keys Conveyancing & Associates before they start their marketing campaign. A vendor’s statement also known as section 32. It is a document that tells potential buyers’ certain things about the property title they should know before signing a contract to purchase. The vendor is legally responsible for the vendor’s statement. In order to prepare vendor statement, we need to obtain all the “prescribed documents” such as council zoning certificates, a copy of the title and other relevant documents.
The vendor Statement allows buyers to confidently enter in a contract of sale in the knowledge that there aren’t currently any adverse interests registered against the property. If a vendor statement is incorrect, or in complete, it will give the buyer the right to terminate the contract of sale.
A vendor statement is therefore an important document in the conveyancing process and in order to avoid errors it is recommended that you engage us to prepare the document on your behalf.
Cooling-off period
Every standard Contract of Sale for residential property includes a 3 clear business days cooling-off period, starting the next day the purchaser signed the Contract of sale. If the purchaser backs out from the contract, they required to pay you 0.2% of the purchase price or $100 whichever amount is higher.
Deposit
Typically, 10% of the purchase price is the deposit paid on exchange of contract. However, this may be negotiated by the parties before signing the contract of sale. The deposit may be in cash, bank guarantee or deposit bond. Most cost deposits are held in an in the real estate agents trust account and will be release to the vendor after the settlement.
Settlement
Settlement is the date that your property is legally transferred to the purchaser and the balance of the purchase price is paid to you.
